SCM has helped shape development in the West through its leadership in water law.
We understand the critical need for water in a wide range of industries, including agriculture, municipal water, and resort development. Our firm is actively engaged in all aspects of state and federal water regulations. Our lawyers have administrative and regulatory practices before the Utah State Engineer, the U.S. Department of the Interior, and the U.S. Forest Service.
Our water law practice involves commercial and other transactions that require skilled negotiations and administrative experience. We handle water rights sales and purchases as well as changes in point of diversion, place, and purpose of use. We obtain required permits, licenses and approvals for construction and operation of water projects.
We have been an integral part of the development and administration of large-scale reclamation projects across Utah. In addition, we assist clients in the administration, purchase, sale, and protection of individual water resources.
Our water law clients include cities, special districts, developers, irrigation companies, and ranchers. We assist these entities with advice, planning, transactions, negotiations, and litigation.
Water District Representation
For over 60 years, we have served as general counsel to the Metropolitan Water District of Salt Lake City, Utah and Sandy, Utah. In this proud role, we are responsible for all aspects of the District’s legal work.
Pipeline Easements and Condemnation
Large-scale transportation of water requires pipelines. As water systems expand and additional pipelines are constructed, land belonging to private individuals and entities often must be condemned for placing pipelines. In these situations, we assist entities by advising of the legal condemnation requirements. We then support and represent their interests in court when faced with challenges to the overall process or property valuation.
In addition to representing clients in condemnation matters, we also advise clients in virtually all areas involving water disputes. This includes issues in federal and state court litigation, including special state water courts, and in contested administrative proceedings before state and federal water officials.
